1. Acceptance of Terms

By downloading, accessing, or using the MediFakt application or any related service (together, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

2. Eligibility and Your Account

• You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, to create an account and use the App's game and features. You must be at least 18 years old to connect a digital wallet or access SOLEFAKT related features. You are responsible for ensuring that your access to and use of the App and Services complied with the laws of your country of residence.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate registration information and to notify us promptly of any suspected unauthorised access.

3. App & FaktPoints and SOLEFAKT

Access to the App is permitted on a temporary basis, and we reserve the right to withdraw or amend the Platform without notice. We will not be liable if, for any reason, the App is unavailable at any time or for any period. From time to time, we may restrict access to some or all parts of the App.

We may from time to time change the rate at which users accumulate FaktPoints, or the rate at which FaktPoints convert into SOLFAKT, through the App. We may reverse FaktPoints or SOLFAKT allocated to you if we reasonably consider the circumstances justify a reversal — for example, if they were allocated by mistake, or accumulated through misuse of the App or Services, or in a way that is fraudulent, dishonest, or otherwise unacceptable.

If you connect a digital wallet to the App to receive SOLFAKT, you are solely responsible for the security of that wallet and any credentials used to access it. MediFakt is not liable for losses arising from a lost, compromised, or misused wallet.

We make no representation and give no warranty that SOLFAKT will have any value, or any monetary value at all, at the time it is received or at any point afterward. You are solely responsible for any loss or diminution in value of SOLFAKT held in your connected wallet.

FaktPoints are an in-app measurement of engagement with the Platform's games and features and are separate and distinct from SOLFAKT. FaktPoints:

• Have no cash value on their own and are not a currency, security, deposit, or financial instrument of any kind.
• Cannot be purchased with cash, sold, or transferred directly between users.
• May be adjusted, reset, or reweighted by MediFakt from time to time, with reasonable notice provided for material changes.

If you choose to connect a compatible Solana wallet, accumulated FaktPoints may be converted into SOLFAKT through the App's official conversion mechanism, at a rate determined by MediFakt. This is the only way FaktPoints convert into any digital asset — there is no other exchange, resale, or transfer mechanism for FaktPoints outside of this official process. SOLFAKT is a separate digital token from FaktPoints and is not itself a currency, security, deposit, or investment product.

MediFakt reserves the right to void FaktPoints or SOLFAKT earned or accumulated through fraudulent, automated, or abusive means, as described in Section 4.

4. Fair Use and Anti-Abuse

• The Platform is intended for genuine individual engagement with our games and features.
• Use of bots, scripts, emulators, multiple accounts, or any automated or falsified means to generate FaktPoints is strictly prohibited.
• Any attempt to manipulate, exploit, reverse-engineer, or interfere with the Platform's operation, security, or fairness may result in suspension or termination of your account and forfeiture of accrued FaktPoints.

5. Wellness and Health Disclaimer

MediFakt is a wellness and entertainment platform. It is not a medical device, diagnostic tool, or healthcare service, and nothing in the Platform constitutes as medical advice. Our cognitive games are designed to support general mental wellness and engagement, not to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional regarding any health concerns.

6. Intellectual Property

All content available through the Platform — including game design, artwork, software, branding, and the MediFakt and FaktUp names and logos — is owned by MediFakt or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our prior written permission.

7. Amendments to the Terms of Use

We reserve the right to amend these Terms of Use from time to time. Amendments where relevant will be effective immediately upon notification on the App or through the Services. Your continued use of the App and the Services following such notification will represent an agreement by you to be bound by the Terms of Use as amended.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MediFakt shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total aggregate liability to you for any claim arising from these Terms or the Platform shall not exceed the amount, if any, you paid to MediFakt in the twelve (12) months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms, including through fraudulent or abusive activity. Upon termination for cause, accrued FaktPoints may be forfeited. You may stop using the Platform and request account deletion at any time in accordance with our Privacy Policy.

10. Governing Law and Disputes

Any disputes arising from these Terms shall be resolved through binding arbitration under the ICC International Court of Arbitration rules, conducted in English.

11. Waiver

A right under these Terms of Use may only be waived in writing signed by the party granting the waiver and is effective only to the extent specifically set out in the waiver.
